This contribution is an invitation to consider the professional situation in a way that goes beyond a social meaning or a subjective approach. Understood as an intermediate object, the professional situation is studied as a result of tension between invariance and perspective. The data centre on the activity of counselors whose role is to guide farmers confronted with agro-environmental standards. This text brings into question on one hand the attributions qualifying the situation as «professional» and that attest to a form (...) of invariance; and on the other, the counselors’ activity of understanding the «perspective» of the farmers with whom they are in relation. Finally, the article suggests three avenues for future work on the notion of professional situation. Cette contribution invite à considérer la situation professionnelle au-delà d’une acception sociale d’un côté et d’une approche subjective d’autre part. Entendue comme objet intermédiaire, la situation professionnelle est étudiée comme résultant d’une tension entre invariance et perspective. The literature contains two concepts of corruption which are often confused with one another: corruption as twisted character (pollution), and corruption as disloyalty. It also contains two sites for corruption: the corruption of individuals, and the corruption of entire institutions such as a state or a legislature.This paper first draws a clear distinction between the pollution and disloyalty concepts of corruption in the individual context, and then defends a conception of disloyalty corruption according to which the distinguishing feature is an (...) agent who uses powers delegated to her from her principal as her own. Then, the paper shifts gears to the institutional context, arguing that the best account of institutional corruption in the extant literature is of the pollution kind. It then fills the remaining logical space by laying out a conception of institutional corruption as disloyalty and explaining its moral significance for the political legitimacy of a democracy. Michael Stocker’s “The Schizophrenia of Modern Ethical Theories” attacks versions of consequentialism and deontological ethics on the grounds that they are self-effacing. While it is often thought that Stocker’s argument gives us a reason to favour virtue ethics over those other theories, Simon Keller has argued that this is a mistake. He claims that virtue ethics is also self-effacing, and is therefore afflicted with the self-effacement- related problems that Stocker identifies in consequentialism and deontology. This paper defends virtue ethics against (...) this claim. Although there is a kind of self-effacement invol- ved in the exercise of virtue, this is quite different from the so-called schizophrenia that Stocker thinks is induced by modern ethical theory. Importantly, manifesting virtue does not require one to embrace mutually inconsistent moral commitments, as is at times encouraged by consequentialists and deontologists. This paper also considers a reading of the virtue-ethical criterion of right action that is encouraged by Bernard Williams’s distinction between a de re and a de dicto interpretation of the phrase “acting as the virtuous person would.” I argue that such a reading addresses concerns that a virtue-ethi- cal criterion of right action inevitably generates a problematic form of self-effacement. The most successful aspect of The Great Guide is the “Hop-On Hop-Off” intellectual tour that it offers. The reader is taken around the various locations where Hume’s life and ideas developed, moving from country to country, city to city, and stopping off at a few stately homes en route. This tour begins with Hume’s birthplace and (...) early education in Edinburgh and the Scottish Borders, moves on to La Flèche in France (where Hume composed much of his Treatise of Human Nature), then back to London and England, and carries on from there. As we travel around with Hume, Baggini provides his readers with a steady commentary and description of his subject’s various friendships and controversies, along with brief sketches of Hume’s core ideas and contributions. All this is lively and engaging. But there are limitations to Baggini’s method and approach. ... Perhaps the most unsatisfactory aspect of Baggini’s book is his effort to turn Hume’s life and philosophy into a self-help manual. It is true that there is much about both Hume’s character and philosophy to admire, but it is not obvious that this is usefully packaged into a set of 145 'maxims' guiding us towards 'the good life'. ... This article proposes a new interpretation of the concept of Kairos in Paul Tillich's theology. It suggests that Tillich gave it exactly the same meaning as that of the Greek New Testament, i.e. the propitious moment in history for the advent of the Son of Man. Tillich's writings offer indications of the metaphysical qualities of this mysterious character.

Éric Delassus | : Selon Fabienne Brugère, un point de rencontre existe entre l’éthique spinoziste et les éthiques du care, le care pouvant être envisagé comme une réactualisation du conatus spinoziste. Cet article vise à démontrer que cette convergence peut s’établir à partir d’une éthique narrative inspirée de la pensée de Paul Ricoeur. Cela concerne principalement la perception que l’on peut avoir de soi en tant que corps et esprit, dans la mesure où l’esprit est défini par Baruch Spinoza (...) comme « idée du corps ». L’éthique spinoziste invite à se rendre utile aux autres pour augmenter notre puissance d’être et nous libérer d’une servitude qui n’est pas sans rapport avec la vulnérabilité telle que définie dans les éthiques du care. L’humain.e vulnérable a besoin pour se sentir exister d’avoir une idée cohérente de son corps, et le récit est l’une des voies lui permettant de progresser dans cette direction. Encore faut-il, pour y parvenir, trouver des pourvoyeuses et pourvoyeurs de care disposé.e.s à écouter, aptes à susciter en soi le désir de se raconter. | : According to Fabienne Brugère, there is common ground between Spinoza’s ethics and the ethics of care, which can be regarded as a renewal of the Spinozan concept of ‘conatus.’ This article aims to demonstrate that this form of convergence can be based upon a narrative ethic as inspired by Paul Ricoeur’s thought. It is mainly about how people can perceive themselves both as mind and body, insofar as “mind” is defined by Spinoza as the “idea of the body.” The Spinozan ethic leads us to make ourselves useful to other people in order to expand our capacity to be and to free ourselves from a form of servitude that is somewhat linked to vulnerability as it is defined in the ethics of care. Therefore, vulnerable people each need to develop consistent ideas of their bodies if they wish to feel that they do exist. Narrative is one of the many ways of advancing in that direction. However, vulnerable people should not be alone; they must be accompanied by care providers who have a sympathetic ear and who can arouse in them the desire to tell and share their stories. (shrink)

This article proposes, firstly, a general study of the ideological positioning of the Société scientifique de Bruxelles during the first forty years of its existence by means of a detailed reconstruction of its programme, and, secondly, a specific account of its situation within the alternative represented by the Intransigent and Progressive Catholic camps. In order to achieve this objective, it favours the motto of the Société and the figure of its second Secretary, namely Paul Mansion, basing itself primarily on (...) a corpus of texts consisting of his annual reports and those of his predecessor, Father Carbonnelle. While taking particular care in identifying that which, following the Roman injunction in 1890, might have differentiated Mansion’s mandate from Carbonnelle’s, it offers to test the hypothesis that this difference lies, not only in a more favourable attitude towards neo-Thomism, but also in the transition from an intransigent apologetics to a more balanced apologetics. Compared to the existing bibliographies devoted to Paul Mansion, this list of his written and spoken words increases the number of items pertaining to the Annales de la Société scientifique de Bruxelles from 123 to 208, and from 32 to 142 for those pertaining to the Revue des questions scientifiques, thus representing an increase of 40% and 77%, respectively. Based directly on an analysis of these two journals themselves, it makes the relevant bibliographical information — contained both in these (...) earlier bibliographies and in the analytical indexes devoted to these journals — accessible to researchers in a more accurate, convenient and comprehensive manner. The paper aims to explain how Paul Ricœur’s phenomenological and hermeneutic approach offers an original theory of the self as self-attestation. Considering useful an approach that combines the psychological uses of the notion of self with a reflection on one’s capacity to design himself/herself as a person, the paper offers a thorough analysis of Ricœur’s work Soi-même comme un autre / Oneself as Another. The main purpose of this analysis is to highlight that, drawing a clear distinction between two (...) forms of identity (la mêmeté/sameness and l’ipséité/selfhood) and proposing a dialectic between the self and the other, Ricœur grounds his theory on a notion of self which includes one’s acceptance of the other. Cette recherche se concentre sur la problématique de la méthode dans l’herméneutique ricœurienne et sa relation étroite avec les sciences humaines et sociales. Cette problématique concerne aussi bien l’herméneutique ricœurienne des symboles et des signes, que les théories du texte, de l’action et de l’histoire. Notre recherche vise premièrement à analyser la dialectique que Ricœur s’efforce d’établir, aussi bien dans l’herméneutique que dans les sciences humaines et sociales, entre des approches explicatives et des approches compréhensives, entre l’herméneutique du soupçon et (...) l’herméneutique de la foi, entre l’archéologie et la téléologie, et particulièrement entre la compréhension et l’explication. Deuxièmement, tout en analysant la relation entre la compréhension, l'explication et l'interprétation, la recherche propose une herméneutique du discours oral, en général, et du dialogue, en particulier. L'herméneutique proposée dans cette recherche dépasse relativement l'herméneutique de Ricœur qui exclut explicitement le discours oral de son herméneutique. Toutefois, elle est également considérée comme une extension de l'herméneutique ricœurienne, car elle est fondée sur son paradigme du texte et celui de la traduction. La recherche suggère que le paradigme ricœurien de la traduction peut être considéré, à la fois, comme le paradigme principal de l'herméneutique proposée du discours oral, d’un côté, et comme le troisième paradigme de l'herméneutique ricœurienne, de l’autre côté, tout en sachant que le paradigme du symbole et celui du texte sont considérés respectivement comme le premier et le second paradigme de cette herméneutique. ..................... This thesis focuses on the problem of method in the hermeneutics of Paul Ricœur and its close relationship with the human and social sciences. The problem of method is discussed in Ricœur’s hermeneutics of symbols and signs and his hermeneutics of text and of action. The thesis analyses Ricœur’s dialectics between explanatory method and comprehensive method, the hermeneutics of suspicion and the hermeneutics of faith, archaeology and teleology, and particularly between understanding and explanation. This dialectic was established by Ricœur in his work on the different theories of symbol, text, metaphor, action and history. While discussing the relationship between understanding, explanation and interpretation, the thesis proposes a hermeneutics of oral discourse in general and of dialogue in particular. The hermeneutics proposed in this thesis go beyond Ricœur’s hermeneutics which explicitly excludes spoken discourse. However, it is also considered as an extension of the hermeneutics of Ricœur since it is based on Ricœur’s paradigm of text and translation. Thus, in addition to Ricœur’s hermeneutic paradigm of symbol and of text, this thesis suggests that Ricœur’s paradigm of translation is the main paradigm of the proposed hermeneutics of oral discourse and can be considered as the third paradigm of Ricœur’s hermeneutics. Nous distinguons ordinairement le corps de l’esprit : nous parvenons aisément à concevoir (même si nous n’y croyons pas forcément) que notre esprit survive à notre corps, ou qu’il aille se loger dans un autre corps. Il y a là, pensons-nous, une véritable différence de nature. Mais bien que cette distinction nous soit très intuitive, dès lors que nous cherchons à spécifier le critère sur lequel elle repose, elle se dérobe. Tout se passe comme si nous n’avions aucun mal à (...) classer les choses d’un côté ou de l’autre de la frontière qui sépare le corps de l’esprit, mais que nous ne parvenions pas à la définir précisément. A quel critère obéissons- nous en effet lorsque nous opérons une bipartition entre phénomènes mentaux et phénomènes physiques dans un ensemble tel que : une croyance, le téléphone du salon, un aimant, l’envie d’un florentin, le Mont Blanc, la vue du Mont Blanc, un claquement de porte, un regret, le bruit d’un moulin, la connaissance du théorème de Thalès, la jalousie, la couleur de la neige, le souvenir d’un citronnier à Menton ? Nous serions probablement tous d’accord pour ranger du côté des phénomènes physiques le téléphone du salon, le claquement de porte, la couleur de la neige, l’aimant, le Mont Blanc et le bruit du moulin ; et du côté des phénomènes mentaux la croyance, l’envie d’un florentin, le regret, la vue du Mont Blanc, la connaissance du théorème de Thalès, la jalousie et le souvenir d’un citronnier de Menton. Mais nous divergerions probablement si nous avions à formuler le critère d’après lequel nous avons opéré cette bipartition. La première chose à faire est donc de tenter d’examiner les critères qui peuvent nous permettre d’établir la distinction entre le corps et l’esprit afin de retenir le plus pertinent. Dans la mesure du possible, celui-ci devra être à la fois informatif (ne pas nous renvoyer simplement à la distinction intuitive que nous pratiquons quotidiennement) et neutre (par exemple être acceptable aussi bien par un dualiste que par un matérialiste). Une fois cette distinction établie, nous serons en mesure de poser trois problèmes. (shrink)

In questo contributo del 2008 si dimostra, attraverso un confronto con le posizioni di Max Scheler, che Alsberg con il disimpegno corporeo (Körperausschaltung) non mira a esonerare l’organismo (nel senso della Entlastung di Gehlen). Per Alsberg l’evoluzione sociale avviene attraverso utensili, ma l’utensile non si limita a essere un’appendice del corpo, bensì rappresenta una logica estranea a quella del corpo. La Körperausschaltung è il killer del corpo. L’errore di Spencer è quello di non comprendere che un’evoluzione basata su utensili non (...) è semplicemente “sovra-organica”, ma piuttosto “extraorganica”. Extra-organico per Alsberg significa che l’utensile è al di fuori della logica del corpo. Ed è proprio l’autonomia dell’utensile dalla biologia a permettere di risolvere il paradosso della duplicità costitutiva dell’uomo: l’essere il motore di un’evoluzione extra-organica che produce contemporaneamente involuzione organica. Il “disimpegno organico” che libera l’uomo dal bisogno è possibile solo perché il problema dell’adattamento e dell’evoluzione viene spostato sul piano extra-organico: tale spostamento è ciò che contraddistingue l’uomo da tutti gli altri esseri viventi, quindi il principio costitutivo dell’esser umano. L' Ausschaltung, come disattivazione del corpo (dal verbo tedesco auschalten, nel senso di spegnere, ad es. una macchina, la luce ecc.) diventa pertanto il principio ultimo per comprendere l'umano nella sua interezza e non solo l'uomo della modernità (l'homo faber). L'eccezionale testo di Alsberg rimarrà praticamente sconosciuto, tuttavia con eccezioni di rilievo: già negli anni '20 ha un impatto decisivo su Max Scheler e sul progetto di fondazione dell'antropologia filosofica. Successivamente, ma con esiti opposti, su Gehlen. Il concetto di Körperausschaltung viene ripreso anche da Dieter Claessens, da Hans Blumenberg e infine da Sloterdijk. (shrink)

Este texto se propone explorar la relación intelectual de Jean-Paul Sartre y Michel Foucault respecto de su activismo intelectual en la forma de sus manifestaciones públicas. Además de ello, también busca analizar sus desacuerdos teóricos y la forma en la cual se debatió en favor de cada una de sus consideraciones filosóficas y los posicionamientos que asumieron uno y otro autor respecto de la sociedad a la cual les tocó asistir. De otra parte, también se asume que existe un (...) punto de conexión teórica en relación al concepto de resistencia que se puede derivar de la crítica al capitalismo en Sartre y de la crítica al neoliberalismo en Foucault. In this essay, I argue that Valéry's poetic reflections offer valuable insights on the ancient (Aristotelian) ideal of beauty as perfection, which he rehabilitates and updates. I also show that these clarifications provide solutions to enduring aesthetic problems. To do this, I start from the modal vocabulary (necessary, possible, arbitrary) Valéry uses each time he wants to describe the relationship of an author to his composition. He therefore seems to have been deeply fascinated by the tension between the fact that (...) a creator is always free to compose what he wants, and the fact that the same creator wants his work or parts of it to be imposed on him, while he is in the midst of his creative process. Here comes into play the ideal in question, since the perfection of a work implies, among other things, that one cannot want to modify this work for the better (being already perfect). After a detour aiming to introduce the importance of the rules of composition and to refute the idea that this ideal would no longer have any relevance in a modern artistic perspective, I detail what could be called the "aesthetic holism" of Valéry, which retains from a work only its formal dimension, considered in an original way as a formal whole composed of other formal parts. It is therefore above all a form that must be perfected, against possible relative deprivations (lacks or defects). Then, I link (with the help of Wittgenstein) the modal vocabulary to this notion of form which, by posing compositional challenges, turns out to be essential to the understanding of beauty as perfection. -/- Dans cet essai, je soutiens que les réflexions poétiques de Valéry offrent des éclaircissements particulièrement précieux sur l’idéal ancien (Aristotélicien) de beauté comme perfection, qu’il réhabilite et réactualise. Je défends également l’idée que ces éclaircissements peuvent nous mettre sur la voie de solutions à des problèmes endurants de l’esthétique. Pour ce faire, je pars de l’usage remarquable que Valéry fait d’un vocabulaire modal (nécessaire, possible, arbitraire) chaque fois qu’il veut décrire de quelle manière un auteur se rapporte à sa composition. Il apparaît ainsi que ce qui a profondément fasciné Valéry, c’est le dilemme ou la tension selon laquelle tout en étant libre de composer comme il l’entend (en laissant libre cours à sa fantaisie), un créateur aspire néanmoins à ce que son œuvre ou les parties de cette dernière s’imposent à lui, pendant qu’il crée. Ici entre en jeu l’idéal en question, car la perfection d’une œuvre implique entre autre chose que nous ne puissions vouloir modifier cette œuvre pour le mieux (celle-ci étant justement déjà parfaite). Après un détour visant à introduire l’importance des règles de composition et à réfuter l’idée que cet idéal n’aurait plus de pertinence dans une perspective artistique moderne, je détaille ce que l’on pourrait appeler le « holisme esthétique » de Valéry, qui ne retient de la composition d’une œuvre que sa dimension formelle, envisagée de manière originale comme une totalité faite d’autres parties formelles. C’est donc avant toute chose une forme qu’il faut parfaire, contre d’éventuelles privations relatives (manques ou défauts). Il s’agit alors de connecter (à l’aide de Wittgenstein) ce vocabulaire modale à cette notion de forme qui, en posant des enjeux de composition, se révèle indispensable à la compréhension de la beauté comme perfection. Après une défense à contretemps des traditions formelles dans la création (puisque ce sont de telles traditions qui constituent les ressources par lesquelles un individu libre et autonome peut vouloir, non seulement se faire l’héritier de ces traditions, mais aussi se montrer original et innovant), je termine en appliquant les idées de Valéry au débat qui a opposé un camp « généraliste » à un camp « particulariste » en matière de raisons esthétiques. Michèle Le Dœuff considers the relationship between Jean-Paul Sartre and Simone de Beauvoir as a paradigmatic case of what she calls an "erotico-theoretical transference" relationship: De Beauvoir devoted herself to Sartre theoretically by adopting his existentialist perspective for the analysis of reality in general and the analysis of women's oppression in particular. The latter is especially strange since Sartre used strongly sexist metaphors and adopted a macho attitude towards women. In her book Hipparchia's Choice, Le Dœuff speaks in this (...) context of "theoretical masculinism." She convincingly shows in this book that Sartre without using images could not have closed his existentialist philosophy: without the feminine drawback he would not have been able to explain why man cannot become god. Sartre not only understands gaining knowledge as a rape of a woman he also fears that the possessed feminine (body) could reverse its position from being dominated to the dominating force by appropriating the masculine through slime. In Being and Nothingness Sartre states that "slime is the revenge of the In-itself. A sickly–sweet, feminine revenge." Despite of the fact that De Beauvoir used Sartre's heterosexist ontology and metaphysics she managed to provide a highly influential depiction of women's condition and offered an original approach to the understanding of selfhood which places woman inside the subject. The immediate aim of this paper is to articulate the essential features of an alternative compatibilist position, one that is responsive to sources of resistance to the compatibilist program based on considerations of fate and luck. The approach taken relies on distinguishing carefully between issues of skepticism and pessimism as they arise in this context. A compatibilism that is properly responsive to concerns about fate and luck is committed to what I describe as free will pessimism, which is to be (...) distinguished from free will skepticism. Free will skepticism is the view that our vulnerability to conditions of fate and luck serve to discredit our view of ourselves as free and responsible agents. Free will pessimism rejects free will scepticism, since the basis of its pessimism rests with the assumption that we are free and responsible agents who are, nevertheless, subject to fate and luck in this aspect of our lives. According to free will pessimism, all the major parties and positions in the free will debate, including that of skepticism, are modes of evasion and distortion regarding our human predicament in respect of agency and moral life. On March 9th, 1985, Paul Ricoeur and Cornelius Castoriadis met at the studio of the France Culture “Le Bon Plaisir” radio broadcaster. In 2016, the transcript of their dialogue, their only public debate, was published. Extant theoretical work on the political resource curse implies that dependence on resource revenues should decrease autocracies’ likelihood of democratizing but not necessarily affect democracies’ chances of survival. Yet most previous empirical studies estimate models that are ill-suited to address this claim. We improve upon earlier studies, estimating a dynamic logit model that interacts a continuous measure of resource dependence with an indicator of regime type using data from 166 countries, covering the period from 1816-2006. We find that an increase (...) in resource dependence at time t - 1 increases the likelihood of autocratic persistence at t, but has no appreciable effect on democratic survival. We go beyond existing empirical studies to show that increases in resource dependence have persistent and substantial cumulative effects on autocracies' likelihood of becoming democratic over the long-term, showing that the total effect of resource dependence on regime type is much larger than the short-term (one period) effect indicates. This essay is a Neo-Aristotelian critique of Frans de Waal’s evolutionary moral sentimentalism. For a sentimentalist, moral judgments are rooted in reactive attitudes such as empathy, and De Waal argues that higher primates have the capacity for empathy—they can read other agent’s minds and react appropriately. De Waal concludes that the building blocks of human morality—primarily empathy—are present in primate social behavior. I will engage de Waal from within the sentimentalist tradition itself broadly construed and the Aristotelian virtue tradition more (...) specifically. Within an Aristotelian framework, emotion regulation is necessary for moral responsibility. Aristotle understands that emotions are evaluative perceptions with cognitive content, and non-human animals do not possess the cognitive capacities for emotion regulation and are thus not morally responsible. Histoire et utilisation du robot Bien que la robotique soit un marché économique relativement jeune et en pleine croissance, la genèse des robots remonte à l’Antiquité. Le premier robot à être déployé sur des lignes d’assemblage est Unimate, utilisé dès 1961 par General Motors. La robotique, en se di usant dans tous les pans de notre économie, va impacter les business modèles de nombreuses industries comme l’automobile et l’aéronautique mais aussi la construction ou l’agriculture. Aujourd’hui les robots industriels et de (...) service servent à de multiples tâches allant de la logistique à l’usinage en passant par la fonderie. La robotique constitue aussi et surtout un enjeu sociétal contribuant à relever les dé s de la mobilité, de la santé, de l’autonomie, du vieillissement et de l’éducation. Absence de dé nition et de régime juridique spéci que au robot En France, la notion de robot ne fait pas l’objet d’une dé nition juridique qui lui est propre. Les dé nitions relatives à l’environnement robotique peuvent tout de même se retrouver dans la norme ISO 8373:2012. Bien que les robots intéressent les juristes à plusieurs titres, le législateur n’a, à ce jour, pas adopté de régime juridique spéci quement applicable aux robots. Il convient donc de rechercher dans le droit positif le corpus de textes applicables aux robots. Ce corpus pourra alors recevoir l’appellation de « droit de la robotique ». Garanties Le vendeur d’un robot industriel et de service doit se conformer aux garanties légales que sont la garantie des vices cachés et la garantie d’éviction. Il doit également respecter les éventuelles garanties qui ont pu être convenues contractuellement Clauses contractuelles Le fournisseur d’un robot industriel et de service doit être particulièrement attentif aux clauses contractuelles rela- tives à la garantie, à la propriété intellectuelle, à la con dentialité, à la responsabilité et à la conformité aux directives techniques. Les spéci cités liées au robot, telles que les éléments relatifs à l’intelligence arti cielle, pourront être intégrées dans des annexes spéci ques. Intelligence arti cielle L’algorithme d’intelligence arti cielle dont est équipé un robot industriel et de service peut, dans certaines condi- tions, béné cier d’une protection grâce au droit d’auteur, à la protection du savoir-faire et au brevet. Aucun régime spécial n’existe à ce jour protégeant les œuvres conçues par le robot intelligent. Mobilité Les véhicules et drones autonomes utilisés au sein même de l’usine sont considérés comme des machines. Etant don- né les risques existants, il convient de xer de règles internes d’utilisation. Les véhicules autonomes ne peuvent à ce jour quitter l’espace privé. En revanche, les drones peuvent circuler dans l’espace aérien en respectant strictement le cadre réglementaire. Douanes Le taux de perception des droits de douanes d’un robot industriel et de service est conditionné par la connaissance de l’origine, préférentielle ou non préférentielle, du robot qui est déterminée par la position tarifaire de ce dernier. Le robot industriel et de service entre dans le chapitre 84, qui concerne notamment les machines, de la nomenclature du système harmonisé établi par l’Organisation mondiale de douanes. Sécurité En application de la « directive machines », le robot peut recevoir la quali cation de machine ou de quasi-machine. En vertu de cette directive, mais également au titre du Code du travail, de nombreuses obligations en matière de santé et de sécurité doivent être respectées pour la commercialisation et l’utilisation des robots. Conformité Le Code du travail, en transposant la « directive machines », a prévu de nombreuses obligations et procédures, appli- cables aux robots industriels et de service, permettant ainsi de s’assurer que ces derniers respectent les exigences de conformité nécessaires en matière de santé et de sécurité. Maintenance Dans le cadre de la maintenance, le fournisseur d’un robot industriel et de service est soumis à plusieurs obligations législatives aux titres de la disponibilité des pièces détachées et de la location. Les dispositions contractuelles de- vront prendre en considération les spéci cités propres au robot et ne pas ignorer la maintenance prédictive. Quali cation juridique Dans le cadre de la conception, de la fabrication et de l’utilisation du robot, il convient de porter une attention par- ticulière à quatre textes spéciaux qui peuvent être applicables aux robots industriels et de service : le règlement 428/2009 sur les biens à double usage, la directive 2014/35/UE applicable au matériel électrique basse tension, la directive 2014/53/UE applicable aux équipements radioélectriques et la directive 2014/30/UE sur la compatibilité électromagnétique. Responsabilité Bien que les régimes de responsabilité, civile et pénale, ne sont pas adaptés aux robots autonomes, la responsabilité civile de droit commun, la responsabilité du fait des choses, la responsabilité du fait des produits défectueux et la responsabilité des commettants du fait de leurs préposés peuvent s’appliquer en cas de fait dommageable causé par le robot tout comme la responsabilité pénale en cas d’infraction commise dans le cadre de l’utilisation du robot. Assurance La police d’assurance relative aux robots doit permettre de protéger le robot contre les risques auxquels ils sont confrontés mais également d’assurer la responsabilité pour les dommages qu’ils pourraient causer, on peut alors parler de « dommages robotiques ». Données et bases de données Les bases de données contenues dans un robot industriel et de service doivent respecter les droits dont dispose l’auteur sur la structure de la base de données et/ou les droits du producteur des bases de données dans lesquelles gurent les données utilisées. La réglementation Informatique et libertés est également applicable au robot lorsque celui-ci collecte et/ou traite des données personnelles. Droit de la robotique dans le monde Aucun Etat ne s’est à ce jour doté d’un régime juridique détaillé et spéci que à la robotique. Des dispositions juri- diques relatives aux robots peuvent tout de même se retrouver de façon éparse dans certains droits étrangers concer- nant notamment les drones et les véhicules terrestres autonomes. David Ekdahl (2023), in a constructive and thoughtful commentary, outlines both points of agreement with and suggestions for further research arising from our paper ‘Crossing the Fictional Line: Moral Graveness, the Gamer’s Dilemma, and the Paradox of Fictionally Going Too Far’ (Montefiore & Formosa, 2023).

It is one thing to hold that merely statistical evidence is _sometimes_ insufficient for rational belief, as in typical lottery and profiling cases. It is another thing to hold that merely statistical evidence is _always_ insufficient for rational belief. Indeed, there are cases where statistical evidence plainly does justify belief. This project develops a dispositional account of the normativity of statistical evidence, where the dispositions that ground justifying statistical evidence are connected to the goals (= proper function) of objects. There (...) are strong intuitive motivations for doing this. For we can turn almost any case of _non-justifying_ merely statistical evidence into a case of _justifying_ merely statistical evidence by adding information about the dispositions and goals of the objects involved. The resulting view not only helps us understand when and why merely statistical evidence is normatively significant, but it also helps us understand how statistical evidence relates to more standard forms of evidence (perceptual, testimonial). The emerging view also has surprising applications, as it imposes limitations on the epistemic value of fine-tuning arguments for theism as well as undermines a standard class of case-based arguments for moral encroachment. (Spanish) RESUMEN: La libertad absoluta postulada por Viktor Emil Frankl y Jean-Paul Sartre, la Shoah y la creencia en un dios omnipotente, bueno y justo parecen contradecirse. La pregunta por el sentido del sufrimiento de las víctimas del Holocausto (la verdadera catástrofe, el mayor crimen contra la humanidad), simbolizado por Auschwitz, y como punto de inflexión en la historia, es terriblemente dolorosa y parece no tener una respuesta filosófica ni teológica. A mi juicio, es importantísimo distinguir entre las víctimas (...) inocentes de la Shoah que perecieron y las víctimas inocentes que sufrieron un verdadero infierno y perdieron a sus seres queridos, pero que lograron sobrevivir. Ambas son víctimas, por supuesto, pero así como encontrarle un posible sentido al sufrimiento de las víctimas masacradas y gaseadas podría suponer un insulto a su sufrimiento y agonía –en especial, al horror que sufrieron los niños–, el horrible sufrimiento de los supervivientes pudo dar, tal vez, de alguna manera, un sentido a sus vidas después de la liberación de los campos de concentración y exterminio, ya fuera como voz, como protesta o como simple supervivencia. Frankl apuesta por un sentido último (que abraza el sentido del sufrimiento de las víctimas), y Sartre, aunque parezca no apostar por sentido alguno, volcó su vida al compromiso político después de la Segunda Guerra Mundial, y ello parece vislumbrar una minúscula pizca de sentido después de la barbarie. La filosofía de Frankl es un sí a la vida incluso en las situaciones más extremas, un grito casi nietzscheano que exalta el valor de la vida más allá de cualquier sufrimiento. Frankl, padre de la logoterapia y superviviente del Holocausto, abre una puerta a Dios al hablar de un dios inconsciente, una dimensión suprahumana y una fe incondicional, y define la religión como espiritualidad y como la búsqueda del hombre por el sentido último. Según Frankl, la libertad no se contradice con Dios, y la religión existe no a raíz de la barbarie, sino a pesar de la barbarie. El existencialismo sartreano es una filosofía de la libertad radical y de la responsabilidad. El hombre está condenado a ser libre. El ser humano es un ser en el que la existencia precede a la esencia. Somos totalmente responsables de lo que somos. Sartre afirma que la libertad humana es incompatible con Dios. En un mundo sin Dios, la moral la construyen los hombres, con sus propias decisiones y sus acciones, y la existencia y el sufrimiento de las víctimas no tienen sentido alguno. Sartre define al hombre como libertad, responsabilidad, angustia y contingencia. Frankl define al hombre como libertad, responsabilidad, espiritualidad y búsqueda de sentido. Con esta tesis me propongo entrar en la resbaladiza dimensión del dolor, la desesperación, el sentido y sinsentido del sufrimiento de las víctimas (teniendo presente los horrores de Auschwitz, que en teología y filosofía ha simbolizado desde la liberación de los campos la muerte de Dios y la muerte de la moral). Es verdad que no solo los hombres, mujeres y niños judíos fueron víctimas de la barbarie alemana, pero, como reza el mensaje de Elie Wiesel en la exposición permanente del Block 27 del Auschwitz-Birkeanu State Museum: "Not all victims were Jewish in this place, but all Jews were victims". La Shoah no es un episodio dentro de la Segunda Guerra Mundial, sino un punto de inflexión en la historia de la humanidad, y es una catástrofe que nos concierne a todos, hombres y mujeres judíos y no judíos, religiosos e irreligiosos, creyentes e increyentes, como seres libres, responsables y morales que somos –o que deberíamos ser. Muchas de las víctimas del Holocausto, en medio de la desesperación, entraron en las cámaras de gas orando, aferrándose a la esperanza de que ese final espeluznante no era un punto final. Con esta tesis no me propongo de ninguna manera responder a la eterna pregunta de si Dios existe o no, sino que propongo interpretar ese grito hacia Dios como un desesperado anhelo de esperanza. También me propongo encontrar una coherencia en las posturas de estos dos grandes pensadores para quienes la libertad y la responsabilidad definen al hombre: Frankl (quien apuesta por una dimensión suprahumana donde existe un sentido último en el que el sufrimiento de las víctimas tiene que tener algún sentido, aunque ese sentido sea completamente incomprensible en la dimensión humana) y Sartre (el existencialista ateo por excelencia, para quien el mundo, la existencia y el sufrimiento son absolutamente contingentes). En el primer capítulo expongo la logoterapia y el existencialismo sartreano: describo las tres dimensiones del hombre y las tres búsquedas de sentido propuestas por Frankl, y expongo las cinco consecuencias de "l'existence précède l'essence", centrándome en la libertad y la responsabilidad, y hablo del suicidio. El segundo capítulo está dedicado al dios inconsciente frankleano, la dimensión suprahumana, la búsqueda por el sentido último y la fe incondicional. En el tercer capítulo ilustro la libertad sin Dios sartreana, la ontología sartreana, el ateísmo sartreano y el humanismo sartreano, y hablo sobre la responsabilidad, la mauvaise foi, la contingencia, la situation y la angustia. The question of the meaning of the victims' suffering of the Holocaust (the true catastrophe, the biggest crime against humanity), simbolised by Auschwitz and as a turning point in History, is terribly painful and doesn't seem to have an answer. In my opinion, it's crucial to distinguish between the innocent victims of the Shoah who perished and the innocent victims who sufferend a real hell and lost their loved ones, but managed to survive. Both are victims, of course, but just as finding a possible meaning to the suffering of the massacred and gassed victims could result in an insult to their suffering and agony –especially to the horror that the children suffered– the gigantic suffering of the survivors could, maybe, somehow, give a meaning to their lives after the liberation of the concentration and extermination camps, either as a voice, as a protest, or as a simple survival. Frankl believes in an ultimate meaning (that embraces the meaning of the victims' suffering), and Sartre, even if it appears not to embrace any meaning, turned his life to political engagement after War World II, and that attitude seems to give a tiny glimpse of meaning after the barbarity. Frankl's philosophy says yes to life even in the most extreme situations, and it's a Nietzschean-like scream that exalts the value of life beyond any monstrous suffering. Frankl, the father of logotherapy and a Holocaust survivor, opens a door to God when he talks about an unconscious God, a supra-human dimension and an unconditional faith; he defines religion as spirituality and as man's search for ultimate meaning. According to Frankl, freedom is not contradictory with God, and religion exists not because of the barbarity but in spite of the barbarity. Sartrean existentialism is a philosophy of radical freedom and responsibility. Men are condemned to be free. We are beings where the existence precedes the essence. We are completely responsible of what we are. Sartre argues that human freedom is incompatible with God. In a godless world, morality is constructed by people, with their own choices and actions, and human existence and the suffering of the victims don't have any meaning. Sartre defines man as freedom, responsibility, Angst and contingency. Frankl defines man as freedom, responsibility, spirituality and search for meaning. With this dissertation I attempt to enter in the slippery dimension of the pain, despair, meaning and meaninglessness of the victims' suffering (having in mind the horrors of Auschwitz, that in theology and in philosophy have simbolised, since the liberation of the camps, the death of God and the death of morality). It's true that not only Jewish men, women and children were victims of the German barbarity, but, as Elie Wiesel's message from the permanent exhibition from Block 27 of the Auschwitz-Birkeanu State Museum reads: "Not all victims were Jewish in this place, but all Jews were victims". The Shoah is not an episode inside War World II, but a turning point in the history of humankind, and a catastrophe that embraces us all, Jewish and not not Jewish men and women, religious and not religious, believers and not believers, as the free, responsible and moral beings that we all are –or that we should be. A lot of the victims, in the midst of their desperation, entered into the gas chambers praying, holding to the hope that their horrifying end was not the ultimate end. With this dissertation I do not attempt to answer the eternal question of the existence of God, rather, I will try to interpret that scream to God as a longing for hope. I also intend to find a coherence between the thought of these two great thinkers for whom freedom and responsibilty define man: Frankl (who argues that there is a suprahuman dimension where an ultimate meaning exists and where the victims' suffering has to have a meaning, even if this meaning is completely incomprehensible in the human dimension) and Sartre (the atheist existentialist par excellence, for whom the world, human existence and suffering are absolutely contingent). In the first chapter I expose logotherapy and Sartrean existentialism: I describe the three dimensions of man, the three searches for meaning, the five consequences of "l'existence précède l'essence" and I speak about suicide. The second chapter delves into the unconscious God, the supra-human dimension, the ultimate meaning and the unconditional faith. In the third chapter I expose the freedom without God defended by Sartre, Sartre's ontology, Sartre's atheism, Sartre's humanism, and his ideas about responsibility, mauvaise foi, contingency, situation, and Angst. The fourth chapter is necessarily historical (while being philosophical too): I wonder about the death of God after Auschwitz, I argue and defend the uniqueness of the Holocaust (the Shoah is a turning point in the history of humankind), I describe the massacres before the extermination camps (Einsatzgruppen, Ordnungspolizei y Wehrmacht), the gigantic Auschwitz camp complex (Stammlager, Auschwitz-Birkenau y Monowitz-Buna), I reflect on God and evil (focusing on the children of Auschwitz), I describe Frankl's days in Auschwitz, I talk about God as hope, about immortality and escathology, I discuss God's cruelty, the relationship between Christianity and antisemitism and Islam and antisemitism, I question the silence of God, and I talk about the death of God and about the trial against God. In the fifth chapter I talk about the Franklean morality (a morality that concerns man and not God), on the basis of his love theory and his only work of theater (Synchronisation in Binkerwald), and the Sartrean morality (a morality that concerns a humanity without God), remembering Dostoyevsky, analysing Garcin's famous quote in Huis clos "L'enfer, c'est les Autres", crticizing Sartre's marxism and questioning (with Frankl's and Sartre's eyes) Brecht's verse "Erst kommt das Fressen, dann kommt die Moral"; at the end of the chapter I include my own reflection (and Frankl and Sartre's critique) about the impunity of the executioners and collaborators after the Holocaust (with God's permission). After the Conclusion, I add an Appendix about the lives of Frankl and Sartre, which helps understanding better their work. Les principales théories causales de la référence pour les noms propres, et la proposition d'une nouvelle approche basée sur l'analogie de la chaîne des blocs de la technologie de blockchain et la théorie narrative de Paul Ricœur. Après une brève Introduction dans laquelle sont passés en revue les types de propositions du concept de mondes possibles et une vue d'ensemble de la théorie dans La théorie causale de la référence, je présente la théorie causale initiale de la référence proposée (...) par Saul Kripke, puis deux théories causales hybrides développées par Gareth Evans et Michael Devitt. Dans la section Blockchain et l'arbre causal de la référence je présente mon idée de développer une nouvelle théorie causale de la référence pour les noms propres à l'aide d'un arbre causal de la référence. Dans les Conclusions, je parle du développement ultérieur des modes dont les termes de référence pourraient faire référence à certains objets et individus, les principales critiques des théories causales et des suggestions pour un développement futur. Overview of fundamental work in deontic logic.

This paper introduces constitutivism about practical reason, which is the view that we can justify certain normative claims by showing that agents become committed to these claims simply in virtue of acting. According to this view, action has a certain structural feature – a constitutive aim, principle, or standard – that both constitutes events as actions and generates a standard of assessment for action. We can use this standard of assessment to derive normative claims. In short, the authority of certain (...) normative claims arises from the bare fact that we are agents. This essay explains the constitutivst strategy, surveys the extant attempts to generate constitutivist theories, and considers the problems and prospects for the theory. (shrink)

This article shows that Paul Ricoeur and Carol Gilligan develop their theories of the self by borrowing critically from Freudian aesthetics, adding an ethical dimension missing in it. Ricoeur critiques, completes and endorses the Freudian interpretation of the Oedipus, while Gilligan rejects it, since she considers it distorted by patriarchal ideology. Both are reclaiming the Freudian theory of culture by focusing on what Freud called the «life drive» as opposed to the «death drive». But Ricoeur does not pay the (...) same attention as Gilligan to patriarchal ideology conveyed by Greek tragedies. Thus, his ethics remains deeply rooted in the language of the tragic conflict (Oedipus, Antigone), while Gilligan’s ethics seeks to renew the language of pleasure (Cupid and Psyche). -/- ----------- Cet article montre que Paul Ricœur et Carol Gilligan développent leurs théories du soi en puisant de manière critique à l’esthétique freudienne, y ajoutant la dimension éthique manquante. Si Ricœur critique, complète et entérine l’interprétation freudienne de l’Œdipe, Gilligan se distingue davantage de Freud, qu’elle juge biaisé par l’idéologie patriarcale. Tous deux se réapproprient la théorie freudienne de la culture en mettant l’accent sur ce que Freud appelait la «pulsion de vie» par opposition à la «pulsion de mort». Mais comme Ricœur n’accorde pas la même attention que Gilligan à l’idéologie patriarcale véhiculée par les tragédies grecques, son éthique reste profondément enracinée dans le langage du conflit tragique (Œdipe, Antigone), alors que celle de Gilligan cherche à renouveler le langage du plaisir (Cupidon et Psyché). In this chapter, we analyze the relationships between the Internet and its users in terms of situated cognition theory. We first argue that the Internet is a new kind of cognitive ecology, providing almost constant access to a vast amount of digital information that is increasingly more integrated into our cognitive routines. We then briefly introduce situated cognition theory and its species of embedded, embodied, extended, distributed and collective cognition. Having thus set the stage, we begin by taking an embedded (...) cognition view and analyze how the Internet aids certain cognitive tasks. After that, we conceptualize how the Internet enables new kinds of embodied interaction, extends certain aspects of our embodiment, and examine how wearable technologies that monitor physiological, behavioral and contextual states transform the embodied self. On the basis of the degree of cognitive integration between a user and Internet resource, we then look at how and when the Internet extends our cognitive processes. We end this chapter with a discussion of distributed and collective cognition as facilitated by the Internet. (shrink)

JOURNAL OF THE HISTORY OF PHILOSOPHY PRIZE for the best published book in the history of philosophy [Awarded in 2010] _______________ -/- Although it is widely recognized that David Hume's A Treatise of Human Nature (1739-40) belongs among the greatest works of philosophy, there is little agreement about the correct way to interpret his fundamental intentions. It is an established orthodoxy among almost all commentators that skepticism and naturalism are the two dominant themes in this work. The difficulty has been, (...) however, that Hume's skeptical arguments and commitments appear to undermine and discredit his naturalistic ambition to contribute to "the science of man". This schism appears to leave his entire project broken-backed. The solution to this riddle depends on challenging another, closely related, point of orthodoxy: namely, that before Hume published the Treatise he removed almost all material concerned with problems of religion. Russell argues, contrary to this view, that irreligious aims and objectives are fundamental to the Treatise and account for its underlying unity and coherence. It is Hume's basic anti-Christian aims and objectives that serve to shape and direct both his skeptical and naturalistic commitments. When Hume's arguments are viewed from this perspective we can solve, not only puzzles arising from his discussion of various specific issues, we can also explain the intimate and intricate connections that hold his entire project together. This "irreligious" interpretation provides a comprehensive fresh account of the nature of Hume's fundamental aims and ambitions in the Treatise. It also presents a radically different picture of the way in which Hume's project was rooted in the debates and controversies of his own time, placing the Treatise in an irreligious or anti-Chrisitan philosophical tradition that includes Hobbes, Spinoza and freethinking followers. Considered in these terms, Hume's Treatise constitutes the crowning achievement of the Radical Enlightenment. (shrink)

Papers, Please, by Lucas Pope (2013), explores the story of a customs inspector in the fictional political regime of Arstotzka. In this paper we explore the stories, systems and moral themes of Papers, Please in order to illustrate the systemic approach to designing videogames for moral engagement. Next, drawing on the Four Component model of ethical expertise from moral psychology, we contrast this systemic approach with the more common scripted approach. We conclude by demonstrating the different strengths and weaknesses that (...) these two approaches have when it comes to designing videogames that engage the different aspects of a player’s moral expertise. Should a principle of charity be applied to the interpretation of the colour concepts exercised in visual experience? We think not. We shall argue, for one thing, that the grounds for applying a principle of charity are lacking in the case of colour concepts. More importantly, we shall argue that attempts at giving the experience of colour a charitable interpretation either fail to respect obvious features of that experience or fail to interpret it charitably, after all. Charity to visual experience (...) is therefore no motive for resisting the natural, Galilean response to a scientific understanding of light and vision. The best interpretation of colour experience ends up convicting it of widespread and systematic error. (shrink)

The problems arising in this field of philosophy, which are deeply rooted in the history of the subject, are also intimately related to a wide range of other fields, such as law and criminology, moral psychology, theology, and, more recently, neuroscience. Free Will & The Tragic Predicament : Making Sense of Williams -/- The discussion in this paper aims to make better sense of free will and moral responsibility by way of making sense of Bernard Williams’ significant and substantial contribution to this subject. Williams’ fundamental objective is to vindicate moral responsibility by way of freeing it from the distortions and misrepresentations imposed on it by “the morality system”. What Williams rejects, in particular, are the efforts of “morality” to further “deepen” (...) or “refine” the notion of the voluntary, with a view to securing “ultimate justice”. It is these aims and aspirations, he argues, that take us to the precipice of scepticism. In Shame and Necessity (1993) Williams advances a vindicatory genealogy that unmasks the “illusions” and “fantasies” of our current ethical ideas as they relate to agency and responsibility. What we are then left with is the task of “recasting our ethical conceptions” . It is here that Williams is especially insistent on the importance and value of historical consciousness and reflection. The role of our reflections about the Greeks and tragedy is precisely to show that in order to move forward, into the future, we need to first look back at where we have come from. The value of these “untimely” observations is that they provide us with alternatives and options that we might otherwise lack. What we discover, when we consider the Greeks, is their commitment to a “pessimism of strength” that rests on rejecting scepticism. It is this two-sided perspective on our ethical predicament that delivers a more truthful account of our human situation, one that will help us discard those illusions and fantasies of "morality" that we are “better off” without. An account of this kind refuses to accept an optimism that insists that any form of responsible ethical life must be one that is immune to the influence of luck and fate. This is the fundamental lesson that we can learn from the ancient Greeks and that Williams seeks to “recover” for us. (shrink)

Knowledge implies the presence of a positive relation between a person and a fact. Factual ignorance, on the other hand, implies the absence of some positive relation between a person and a fact. The two most influential views of ignorance hold that what is lacking in cases of factual ignorance is knowledge or true belief, but these accounts fail to explain a number of basic facts about ignorance. In their place, we propose a novel and systematic defense of the view (...) that factual ignorance is the absence of awareness, an account that both comes apart from the dominant views and overcomes their deficiencies. Given the important role that ignorance plays in moral and legal theory and our understanding of various epistemic injustices, a precise and theoretically unproblematic account of the nature of ignorance is important not only for normative epistemology, but also for law, ethics, and applied epistemology. In this paper, I explain the kinematics of non-ideal metalinguistic disagreement. This occurs when one speaker has greater control in the joint activity of pairing contents with words in a context. I argue that some forms of non-ideal metalinguistic disagreement are deeply worrying, namely those that involves certain power imbalances. In such cases, a speaker possesses illegitimate control in metalinguistic disagreement owing to the operation of identity prejudice. I call this metalinguistic injustice. The wrong involves restricting a speaker from participating (...) in the processes that determine the epistemic/linguistic resources of a conversation, and/or undermining a speaker's ability to affect metalinguistic outcomes.
